Well, the Govt has a tough case. Skilling is dead. That one is easy. But the big dog, Lay, allegedly has a solid defense. The articles I've read suggest his doddering elder stateman act has a nugget of truth to it. I'll bet his lawyers are poring over the transcripts of Bernie Ebbers shitting the bed in his trial to make sure Ken makes none of the same mistakes.

Skilling, however, will rot longer than any white collar defendant in history. He can't even trade his testimony against Lay for a light sentence. Using Skilling would kill the govt's case and create sympathy for Lay.

Skilling's got nowwhere to point the finger. He. Is. Dead.

And he deserves it.

He plead guilty and has been out of jail for over a year since his plea. I'm guessing his deal has been cut. His sentence is upto ten years.

Isn't anyone pissed that Enron's entire in-house legal isn't locked up for 5 years? Fat cats count on those guys to keep shit straight. It's the in house guys who should be locked up and throw away the key.

How is that possible? Lea Fastow's deal didn't get cut until July 2004, so how did Lay and Skilling have time to be indicted, cut a deal, do whatever time they did, and be out for a year?

Lay sounds like he's doing the Reagan/Bush defense on the arms for hostages stuff.

Nobody wants to prosecute lawyers:

1. They're usually just yes men;

2. They create piles of CYA memos you have to get around (Belichick's TYCO case);

3. They're schooled in deflecting responsibility, so you can rarely, if ever, find them making a decision for anything;

4. You can't prosecute an entire department. You are on a budget.

This zeal for burning in-house counsel at the stake without worrying about what might've actually happened in the interactions between the counsel and their client is why I suggested (last time you brought up this topic) that you repeat this in your next newsletter to your clients, who I'm sure would read this with interest.
