go to page 36- what you don't want to read in an appeals court's opinion- your arguments that the $200 million damage award against your client is excessive can't be heard, because you failed to file a motion for something or other.

people should be more careful with Bill Gates's money.

Heh, the main defense counsel is in my neigborhood--pretty well known as a bigshot. Always nice to see a local guy do bad.

P.S. It was a "judgment as a matter of law" before the matter goes to the jury, similar to a "motion for directed verdict."

I'm sure district judges everywhere appreciate that they will now (if they weren't) get another mailed-in post-trial/pre-verdict motion that they have to consider and reject solely for the purposes of the Federal Circuit's willingness to review the damages verdict more carefully if such a motion is filed before, rather than after, damages are awarded by the jury.

And clients will have to be for an associate to cobble the thing together mid-trial.

The fact that the argument wasn't raised in the trial court suggests that it wasn't a likely winner on the merits in the appellate court, no? Maybe this is just a procedural way to put a dog out of its misery.
