Hello texlex2003@hotmail.com,

I'm seeking an attorney/attorneys who is/are licensed in the state of MISSOURIto take on a case that, according to one attorney has the potential to be a six figure case if I can make the connection between the car accident and the crippling, mental, and physical diseases, illness that came about right after the accident and has been a part of my life every since, I need to know where I go to file this type of case for around 25 million
dollars, for whatever the attorney deems is a fair amount of reparations for what I suffered.

Which is the correct court for this type of lawsuit? Where do I get the paperwork that has to be filled out and submitted? Can I do this to avoid going over the stature of limitations without having an attorney on board?

I have a landmark auto accident case where some very unusual things happened.

The accident occurred at Route K, William Street, and Siemers drive in Cape Girardeau, MO on October 12, 1999

A female ran a red light in her big 1992 GMC Safari van and broadsided me going around 50 miles per hour.

Picture of 1992 GMC Safari

http://www.cardomain.com/memberpage/342867

I had the right of way, two green left turn arrows were in my favor. I was driving a brand new 2000 Red Grand Prix with less than 50 miles on it.

Picture of 2000 Grand Prix

http://www.cardomain.com/memberpage/268275

The female admitted in the police report that she was looking down into her purse and didn't notice the light was red.

I came down with Diabetes just days after the accident along with other mental and physical conditions resulting from the impact of the accident. I have VA physicals, and one ruling from British Columbia so far supporting what I believe to be the cause of my life threathening injuries

My five year statute of limitations expires on October 9, 2004; so I'm turning in the lawsuit paperwork next week.

I can be reached by email, if you are interested in helping me with this case. You can also reach me by phone at 1-573-837-4092

Sincerely,

Clyde L. Benson
Cape Girardeau, Missouri 63701

Respond that you're not licensed in MO and that you recommend he contact an attorey in MO before the statute runs. Point him to some atty referral service.

Put it in terms we can understand --- does this mean John Kerry's career as a DA was as much of a walkover as Vietnam was?

I'm probably wasting my (virtual) breath but this article follows many that don't explain the problem here in MA very well. New public defenders who work full-time for the state probably earn about the same amount as the bar advocates (who could have been doing the work for years) because bar advocates have to pay all overhead, malpractice and health insurance, etc. from the hourly rates. Furthermore, there is a cap on the number of hours that can be billed annually, so it is not possible to do what the guy in Oregon did. End of timmy rant.

Edith Jones holds that Roe v. Wade, redux (on McCorvey's 60(b) motion), is moot. But laments that the case is moot, and, like rain on your wedding day, was itself a case that benefitted from an exception to the mootness rule, given the substantial evidence of harm that abortion causes to women

For obvious reasons, she presumably now also appeals to John Kerry.

It's amazing she couldn't get the rest of the panel to sign their names to such chestnuts as "No longer does the unwed mother face social ostracism" and "It takes no expert prognosticator to know that research on women’s mental and physical health following abortion will yield an eventual medical consensus."

I would bet serious money this gets reversed. Meanwhile, Jones Day's malpractice carrier will be watching the advance sheets wearing Depends.

Quote:

Zealous Defense: In Louisiana, a man by the name of Barbette Williams kidnapped and tried to murder a 6-year-old boy. The kidnapping ended with a 12-hour standoff in which Williams barricaded himself in a house and shot at several officers. Williams was charged with kidnapping and attempted murder and went to trial, where his defense attorney argued that Williams was not guilty by reason of insanity.

Near the close of the defense attorney's case, Williams jumped up, grabbed his attorney, and slashed him in the face with a razor blade in an apparent effort to kill him. According to this story from the Associated Press, the wounded attorney had the following comment with respect to the slashing:
  • "I've contended all along that this guy is nuts, and to be honest, this pretty much confirms it."

A guy who can stay on message with such laser-beam focus deserves a position in this administration's cabinet. He's a defense attorney --- he can replace Rumsfeld?

Obvious: "'We cannot simply suspend or restrict civil liberties until the War of Terror is over, because the War on Terror is unlikely ever to be truly over,'" Judge Gerald Tjoflat wrote for the three-member court. 'September 11, 2001, already a day of immeasurable tragedy, cannot be the day liberty perished in this country.'"

Surprising: Judge Tjoflat is not on the Ninth Circuit.

It's somehow my fault we let the wrong ones go? This is one Dem who won't take a Slavian fall for the excesses of the Administration.

I will, however, take credit for electing a dead man to the Senate from the great state of Missouri.

traffic law news from our friends to the north

  • English-only traffic sign ruled illegal

Toronto — A justice of the peace has ruled that a "no left turn" sign in Toronto is unenforceable because it is not written in both English and French.

The ruling Monday by Justice Alice Napier could result in thousands of traffic tickets being dismissed.

Lawyer Jennifer Myers argued that a traffic sign near Bay and Dundas streets violated the Highway Traffic Act and the French Languages Service Act because it was not in both official languages.

Napier agreed at a night court hearing Monday, and threw out a ticket issued to Myers for making an illegal left turn.

    Myers does not speak French.

Daniel Brown, a law student who represented her in court, said Myers' victory could prove expensive for the city of Toronto.

"Certainly there will be some cost consequences," Brown said. "They will have to update every traffic sign to correspond with the French Languages Services Act."

Mayor David Miller said Tuesday that the city would appeal the decision.

George Bartlett, director of prosecutions for the city of Toronto, said a provision of the Highway Traffic Act that requires French-language signs does not apply because city council never approved it.

Bartlett also said that a decision by a justice of the peace would not set a precedent that invalidates other tickets issued on the basis of English-only signs.

While the laws in Canada may obviously be quite different, most US states have provisions allowing students to appear in court on behalf of clients, usually as part of a clinic, and usually only under the supervision of an admitted attorney.

In traffic court, yes. The "judge" is actually a justice of the peace. I don't know what you call them here.

Unfortunately yes. In SOME states you still have to be licensed (as a Rule 9 Intern) in order to represent someone in court and to be under the supervision of an attorney. You would NEVER call that person just a law student.

Judge: Ex-Enron execs must stand trial together
Former CEO Ken Lay sought to be tried separately.

HOUSTON - A federal court Tuesday ruled that former Enron Corp. chairman Ken Lay should be tried alongside former executives Jeffrey Skilling and Richard Causey on charges linked to the disgraced energy company's collapse.

In his ruling, Judge Lake said motions to split the case into three trials were denied because the defendants failed to show there was a risk that a joint trial would compromise the defendants' rights or prevent a jury from making a judgmentabout guilt or innocence.

For those reasons, "the court concludes that the defendants have failed to demonstrate that the charges against them ... should be severed," Judge Lake wrote.

However, four charges against Lay for bank fraud and false statements to banks regarding personal loans made to him were severed from the case and will have to be tried separately

YOU might not, but I sure would. Some states might try to dress up the pig more, but around these parts, at least, the clinics have names like "Law Students in Court."

And at least the ones who do criminal law are nonetheless in incredibly high demand, because the defendants know it's better to have the complete attention of a law student than be the 50th case of the day for a public defender. The clinics' win rate in litigation tends to be through the roof.

I admit it, I got a low grade in Con Law

From an article on CNN.com re: the likelihood of Bush appointing new justices to the Supreme Court, and Sen. Specter:

Quote:

"I'm saying we don't have anybody of the status of Oliver Wendell Holmes or Louis Brandeis or a (Benjamin) Cardozo or (Thurgood) Marshall," he said. "That we have a court which they're graduates from Courts of Appeals from the District of Columbia, basically, some other Circuit Courts of Appeals, and I think we could use a Holmes or a Brandeis."
Is it just me, or did the reporter cite the wrong Marshall? I would guess that Specter meant John Marshall. Although Thurgood was a legendary lawyer and player in the civil rights movement, most of the relevant books I recall reading said he was very much a mediocre Supreme.

Yes, i am very much bored today, thanks for asking.

According to today's Legal Intelligencer (subscription required) Wolf Block has decided to raise first year salaries to $115k, joing a host of other peer firms that have done so in the last 6 weeks. Dechert and MLB are still out in front in the Philadelphai market at $125k.

I am not exactly sure what is prompting this, but it is certainly good news, as it appears that the bonus wheels might start turning once again.
