That said, what is the First Amendment interest if the White House authorizes it (i.e., says the leaker should be outed)? Protection of moles and weasels in an administration?

While I'm fully in favor of the First Amendment, I don't believe it goes so far as to allow (or sanction) the disclosure of information that is not yours to disclose.

Shall I post those compromising pics of you and Atticus with Club's pussy wife in the name of the first amendment?

No cite, unfortunately, so I can only be left to wonder if the FOXnews story actually contained the words "Woo hoo!" as well. My money says yes.

As a point of comparison, check out the Electoral Vote Predictor.

Interestingly, in contrast to FOX, here the polls they've collected current as of today indicate that "New polls just in from Florida and Ohio give Kerry a 6-point lead in each state."

All of this is subject to the general point that these polls mean next to nothing until, say, September.

Bilmore shouldn't start getting "the vapours" too soon. I don't know if he should be compelled. For example, I do not think it would be wrong to condition a plea bargain for any criminal violation he may have committed by disclosing Plame's identity (disclosure of security secrets) on a requirement that he disclose his source by way of cooperation.

Besides, he's only entitled to the protections of Branzburg, which doesn't assume a result --- he'll be forced to rely on his own Fifth Amendment privilege if (1) there is a probable cause to believe he has clearly relevant information regarding a specific probable violation of law; (2) the information cannot be obtained in some other way that doesn't so heavily infringe on the First Amendment; and (3) there is a compelling and overriding interest in the information.

I'm pro-Shield Law, but I'm not a First Amendment absolutist.
