Law Blog Ethics Quiz: A Judge’s Birthday Celebration

John “Junior” Gotti led a “Happy Birthday” serenade for Judge Shira Scheindlin yesterday during his criminal trial in federal court in Manhattan. Gotti helped the federal judge celebrate her 60th along with crooning prosecutors, a defense lawyer and court personnel. Gotti and Scheindlen have spent a lot of time together — this is his third racketeering trial, with two previous juries failing to reach a verdict. Here’s the story from the New York Post story, “‘Junior’ Sings Soprano.”

Legal experts reportedly criticized Scheindlin for allowing the mini-celebration and raised eyebrows at the fact that the courtroom was closed to the public during the concert. Though not a major legal ethics violation, said Georgetown law professor David Luban, “I think she ought to have stopped it. It casts doubt on the judge’s own partiality if the judge allow the defendant to sing ‘Happy Birthday.’” New York lawyer Chris Murray called it “bizarre” and “inappropriate.”

Judicial Ethics Quiz: Should Judge Scheindlin have allowed Junior to serenade her?
Only if he sang like a canary.

She should have called the bailiff to slap cuffs on them.

Except for the prosecutors. It's okay for them to sing.
I thought the prosecutors job was to make the defendant "sing"

Or have I been watching too many gangster flicks from the 30's?

At least answer the poll question-your personal experience should give you some more cred than you usually have to back up your answer.

Oops -- maybe I wasn't reading, also. Is the question whether I've ever peed in the aisle on an airplane?

New Feature: Dems in the News!

ATLANTA (AP) Civil rights leader [AND PROMINENT DEMOCRAT] Andrew Young, who was hired to help Wal-Mart Stores Inc. improve its public image, said early Friday he stepped down from his position as head of an outside support group.

The move comes on the heels of comments Young made to a newspaper that many felt were racially offensive.

``I think I was on the verge of becoming part of the controversy and I didn't want to become a distraction from the main issues, so I thought I ought to step down,'' Young, a former Atlanta [DEMOCRAT] mayor and U.N. ambassador, told The Associated Press.

In an interview, Young was asked whether he was concerned that Wal-Mart causes smaller, mom-and-pop stores to close.

``Well, I think they should; they ran the 'mom and pop' stores out of my neighborhood,'' the paper quoted Young as saying. ``But you see, those are the people who have been overcharging us, selling us stale bread and bad meat and wilted vegetables. And they sold out and moved to Florida. I think they've ripped off our communities enough. First it was Jews , then it was Koreans and now it's Arabs; very few black people own these stores.''

Hmmmm, didn't he get the memo that the party likes the Arabs. At least the radical Islamic ones...

For me, it will likely just be a quaffable white tonight, something recommended by the wine shop in the 10-15 dollar range.

While vacationing last week, I had the new Abbott's Table. Very enjoyable, as ususal.

Smashing, I am getting some tonite.....

For you, how about Owen Roe's sister winery Sineann's Pinot Gris? I had some Tuesday. Quaffable white, indeed.

I have never had a Sineann white. I will have to look for it.

The Pinot Gris is good, as is the Sineann Gerwurtztraminer. The former should be about $14 give or take a couple of bucks, the latter $18.

October Surprise?

Pakistani officials say the arrest of a top al Qaeda commander could provide clues to the whereabouts of hidden terror cells around the world and to his superiors, Ayman al Zawahiri and Osama bin Laden.

Pakistani police tell ABC News they arrested Matiur Rehman based on leads in the investigation of the foiled plot to blow up U.S.-bound airplanes from London.

Certainly, as long as he doesn't get indicted, Rove has something up his sleeve...

the article doesn't mention the evidentiary basis for the warrent, or even if there were one. I'm troubled that perhaps his rights have been violated.
