What nuance? If they're criminals, charge them and give them access to counsel. If they're prisoners of war, then Bush has declared formal hostilities at an end. Under the Geneva Convention, if hostilities have ceased, we are bound by treaty to release them.
If our democracy means anything, it means that we live by our principals when it comes to civil rights and the rule of law.
