IMHO, the most capital that anyone could gain from this (and it would be ghoulish, tacky, repulsive and all that if anyone tries to capitalize off of a sick man), would be if some pro-life group or another raises a serious flag about how much further any post-Roe world is if Kerry picks the next Justice or two. Other than that, I guess its a weaker argument for pro-choicers (we can remove the threat to Roe if we just get Kerry in to replace him!).
Its the single-issue that gathers the most single-issue voters, so that's why I think its most likely to be used in this context over the next week.
That said, if anyone tries to make political hay out of this over the next week, I'm gonna seriously consider buying my ticket to Chile'.

You think the composition of the Supreme Court is off limits? It is quite likely that the next president will appoint at least 3 justices. If W wins, the Federalist Society will have gone from a club of dorks in law school who sat around drinking Coors beer and eating California table grapes for laughs into the most influential legal organization in the US.
