I disagree. He is probably the most qualified guy up there for the job. He would hold the Republican vote and outwit the Dimwits in the confirmation hearings (he is smarter than they). If the Dims want to flail at him, go for it, Bush's legacy will be complete.

To what end? He's secure in his position and the justice most intellectually respected (whether loved or hated). It's not like he gets an extra vote as CJ. Nominating AJs for CJ is very rare (Renquist was only the 2d?). While he'd ultimately be approved, the Dems would get to put his tit in the wringer. You'd have three confirmations instead of two, giving Dems more time to grandstand, obfuscate and delay. It's just dumb.
Roberts, though, is a solid choice for CJ in that he's young and already half way through the process without major blemishes on his record. Besides, isn't it time America had a gay CJ?
