What a shit law school you were in. Even if that correctly states Texas law, you have to know the steps to avoid application of that rule, through some combination of trusts, asset transfers and such. There's always a way around the rule.

Plus, you'd think that rule would have come up in the 20000 some pages of pleadings- or else she'd have a pretty solid malpractice claim.
