Almost all of my appellate work has been the result of me winning summary judgment and the plaintiff appealing. Even my one post-trial appeal was an appeal of an SJ motion that was denied way early in the case. All legal issues.
Trials are dumb - a case that goes to trial is a failure.

Yup. If you're trying a case, you're losing money. Or not making as much as you should have.
