An actual fashion comment
Nike has come up with this  for Serena to wear at the US Open. Yes, those are sneakers made to look like boots. They are supposed to supply support to the calf muscles. Yeah. Right.

Is there someone out there who could give me a primer on fair use for copyright?
A non-profit wants to use a New Yorker cartoon in a one-time advertisement for a free event in the community "shopper" newspaper (the kind that get delivered on doorsteps weekly w/o subscription). Do they need to get permission from the New Yorker or the cartoonist?
Edited to completely change the topic of the post because board ownership is boring.
ETA: The cartoon would be the basis for commentary on the subject of it -- kind of like "here's the answer to this problem" if that makes any difference.

It depends on the arrangement between the publisher and the artist, but odds are that the New Yorker has the copyright.
You'll want to get a license from them. (Just because the entity is a non-profit does not automatically make the use a "fair use" under copyright). Many publications have re-use programs of some sort, so it may be doable to get such a license.

Surprisingly, one of the best compendiums (albeit directed to laypersons) of copyright resources on the web is Negativland, the NorCal performance art band that got into trouble making a recording of U2 and Casey Kasem going apeshit during a long distance dedication {.mp3} some years back. After the legal battle died down, they took it upon themselves to write manifestos about the role of copyright in derivative works in the digital age.
Again, the links from the Negativland site are designed to explain the inexplicable to the layperson, but are definitely more accessible for problem-solving than reaching for Nimmer.

Any competent patent attorney would know that the copyright belongs to whomever created the work, unless it's assigned to another, and here it is likely that the New Yorker has the copyright, or at least exclusive right to license it, because the New Yorker probably hires attorneys with bigger-but-not-so-you'd-notice breasts and not nincompoops like Gatti.
And don't listen to Gatti. You'll need to get a license, because the balance of the fair use factors does not favor the non-profit, even though it is a non-profit. The New Yorker is likely to get requests like this all the time and almost certainly has an efficient system set up to handle the requests - so Gatti is an idiot for failing to mention this.
