Since you have access to such an authoritative source, why don't you ask him or her to name another instance in which a fedaral appeals court has reversed a criminal conviction and immediately ordered the defendant released from custody even before issuing a written decision?

You could also ask whether Bauer, Easterbrook or Wood has ever reversed a criminal conviction for lack of evidence of guilt before.
