I was presenting the law, not supporting it.
That said, what is the First Amendment interest if the White House authorizes it (i.e., says the leaker should be outed)? Protection of moles and weasels in an administration?
While I'm fully in favor of the First Amendment, I don't believe it goes so far as to allow (or sanction) the disclosure of information that is not yours to disclose.
Shall I post those compromising pics of you and Atticus with Club's pussy wife in the name of the first amendment?

Odd that FOX would get different results from other recent polls in Ohio (Kerry +6 w/ Nader), Florida (+1 ditto) and Pennsylvania (Kerry +6 ditto). Go figure.

Oops.

Exactly.

No, but that's not the case with the journalist forced under pain of perjury to testify. He's just repeating what someone told him.

If you've got 'em, post 'em.

Bush Ahead In Fox News Poll (Election 2004 Polls - General)
The worm is turning. FOXNews is reporting great new polling news for President Bush. On the heels of the just released Gallup poll, FOXNews shows W opening up the start of a can o' whoopass on Senator Kerry.
Bush 48% Kerry 42%
Bush 47% Kerry 40% Nader 3%
Bush's overall job approval stands at 49%-same as the Gallup poll.
Also, FOXNews also did some state polling:
OHIO Bush 47% Kerry 43%
Bush 45% Kerry 41% Nader 4%
PENNSYLVANIA Bush 47% Kerry 44%
Bush 46% Kerry 41% Nader 3%
MICHIGAN Kerry 44% Bush 43%
Bush 42% Kerry 40% Nader 5%
FLORIDA Bush 50% Kerry 41%
Bush 48% Kerry 38% Nader 3%
This poll was done June 22-23. Things are looking up kids. There is a God indeed.
|
No cite, unfortunately, so I can only be left to wonder if the FOXnews story actually contained the words "Woo hoo!" as well. My money says yes.
As a point of comparison, check out the Electoral Vote Predictor.
Interestingly, in contrast to FOX, here the polls they've collected current as of today indicate that "New polls just in from Florida and Ohio give Kerry a 6-point lead in each state."
All of this is subject to the general point that these polls mean next to nothing until, say, September.

I don't know what it is, but am almost certainly against it. Until further notice, you have my proxy on that one.

Bilmore shouldn't start getting "the vapours" too soon. I don't know if he should be compelled. For example, I do not think it would be wrong to condition a plea bargain for any criminal violation he may have committed by disclosing Plame's identity (disclosure of security secrets) on a requirement that he disclose his source by way of cooperation.
Besides, he's only entitled to the protections of Branzburg, which doesn't assume a result --- he'll be forced to rely on his own Fifth Amendment privilege if (1) there is a probable cause to believe he has clearly relevant information regarding a specific probable violation of law; (2) the information cannot be obtained in some other way that doesn't so heavily infringe on the First Amendment; and (3) there is a compelling and overriding interest in the information.
I'm pro-Shield Law, but I'm not a First Amendment absolutist.
