If UPS is delivering the package in either case, why would it make a difference? It seems to me to be a situation in which the delivery folks should be regulated, not the winery.
Unclear to me why we're discussing it on this board. But it seems like a crime to keep people from getting themselves this:

synopsis: DK found the guy pictured above on some on-line dating service. She dutifully reposted his picture and a link to his personal website at the old infirmation boards. He got lots and lots and lots of hits from infirmation.com, so he came to the boards and pitched a royal fit when he saw so many people making fun of him. I believed he threatened litigation, and I'm pretty sure that the pussies over at infirmation sanitized his posts a bit. Plated had a hell of a lot of fun with him on the big board.
It was an entertaining episode for us all.

That was a pile-on to end all pile-ons, but I think you had to be there. I can't access the old board from work (WTF?), but if someone else can, perhaps he or she could link to The Episode.
