Its a straight up breach of contract. I'm pretty solidly certain future performance is excused in most jurisdictions. It ain't the cheating, either. Its the lying. If I don't like how an SO is fucking, sucking, talking, walking, chewing, snoring or whatever, I tell them. I'd expect the same.
