If the judge is smart em busts the panel and entertains a change in venue. To Milwaukee or Madison County IL.

My sense is: 1) the judge is smart, 2) the judge believes that this case should be decided here, where it happened, 3) is very frustrated with the City right now and might consider the venue motion more seriously because or that, but has been able to move jury selection along despite the setbacks caused by the settlement, and his allowing the defense extra peremptories may remedy the venue issue. But I hear what you are saying.

I'm sorry if I somehow gave you the impression that I tacitly admit or agree with anything in any of your lines. I was trying to suggest that I expressly thought your entire post was wrong, that the big idea behind it was misconceived, and that in general what you said was just entirely wrong.

But unlike you, who'll remain dormant when voices you don't like are targeted, I am close to absolutist. I've defended the left when they're cancelled. And I'm calling what DeSantis is doing what it is: Cancel Culture. You prefer to dissemble and change the focus, pretending it doesn't exist. If what DeSantis did isn't cancellation of a sort, what is?
Or are you now going to make the argument that what DeSantis is doing is cancel culture, but what's been done by the left wasn't?
It's your own knot in which you're tied. You figure it out.

The concept of "cancel culture" is a perverted, unfortunate mess, but fortunately you don't need it to say that what DeSantis is doing is wrong. You described it as full-on censorship. No one here disagrees. No one here supports that kind of censorship. The big, stupid idea in your post is your attempt to tie that kind of censorship to Yglesias getting a Substack, and your "I told you so" that if only more people had shouted down that transsexual journalist at Vox, the Governor of Florida wouldn't be trying his hand at full-on censorship.

I'm no jurisprude, but it's a case being brought by the State of Minnesota in state court, so I think the chances of it being moved to Wisconsin are quite low.

I was just responding to Icky's premise. I know nothing about State Court. Fun Fact- I've been practicing since a time when Bilmore could still get erections, but I only now have my first case in state court!

Yeah it was a joke. PLF got it. I am pretty sure it'd be hard to move a case from one state to another.
In fact I have experience with that.
Cases I handle, there isn't a single exposure, like food poisoning; rather there's a long period of exposure that lead to disease, sort of like obesity.
We file a case in NY based on some tangential exposure there. The guy lived in Alabama, with the majority of this tort happening there. Defendants move to have the case dismissed and refiled in Alabama. We say "make the defendants agree to Alabama," so the judge says "Sure."
Case is refiled in Alabama, where Alabama defense lawyer says "Wait, the IMPORTANT exposure is in NY, dismiss it judge, and _I_ never agreed to Alabama" so the judge says "GTFO, plaintiff. Bye."
So now what, we refile in Cook County IL where the judges don't seem to give a fuck. There are 5 firms splitting the fee and who the fuck knows what's gonna happen.

Yes, I did get it.
In the meantime, the defense (predictably) brought up the state’s latest press conference about the settlement, defending their earlier press conference about the settlement. The judge (predictably) was quite pleased with the City for continuing to exacerbate the problems caused by what seems like a stupid decision in the first place:
“I've asked Minneapolis to stop talking about it. They keep talking about it. We keep talking about it. Everybody just stop talking about it,” he told the court. “Let me decide what the ramifications are."

Jury selection has revealed yet another complication in trying cops: having experience interacting with is entertained as a non-discriminatory reason to challenge even if it isn't.
To the judge's credit, he didn't view is as a reason to dismiss for cause, but getting rid people because they have experience with the MPD isn't a recipe for a fair jury either.

Seriously? As others have said it was a mythical proposal, but you have a white cop who murdered a black man in a city that is 18% black and you move it to a 38% black city. I think the d would have a cause for ew trial. Again, I took crim law pass/fail I know nothing but gotta be a problem with thatfictional move.

Judge just seemed to say "STFU, news flash it's a high profile case."

You don't, and maybe he'd have done it anyway. But one would think an effort to censor at such a granular level - intended to actually censor, as opposed to scoring political points - would be done quietly, hidden to avoid public scrutiny.
But that's not what happened here. Here it was announced to the public. Why? To score political points in the new "You cancel me; I cancel you" game that is American politics.

Um, no. This is a discrete point. Here I'm simply saying what I anticipated would happen happened. And that thing is not the mere effort at censorship. In fact, by publicizing this, DeSantis is inviting a challenge that may result in a court ruling he cannot engage in such censorship. But he doesn't care. That's not what he wants. What he wants is the public notoriety for having joined the "cancel war" with the biggest cannon of all: State Enforced Censorship.
The Biden wing of the party is throwing so much cash around they should be able to hold the House in 2022. But the social justice/cancel-everybody-who-triggers-you wing is like a termite farm eating the planking of what Biden is trying to build. If the Dems lose the House in 2022, you can blame a culture war their crazy left wing decided to ramp up against an enemy far more skilled in that sort of warfare, and utterly nihilistic.

It's not that hard to get a case dismissed for forum non. But I agree that Cook County judges don't give a fuck. However, I don't recommend getting admitted PHV, flying in from NJ, and then telling the Cook County judge "this isn't how we do things in New Jersey." That judge suddenly gave a fuck.
