I don't get the gf part. If he was a paranoid psycho who got in a fight with someone because someone he knew was a completely different person, but who looked kinda the same and was from sort of the same neighborhood as someone who had done him wrong, because he was high on being a tough guy and thought he could kick the ass of the look-alike but not the actual offender, I would have understood better.

Two things.

1.) The law says nothing about "novelty". It just says that you can't sell obscene devices, and lists dildoes and artificial vaginas as per se obscene devices. Everything else is up to interpretation. An obscene device is "designed or marketed as useful primarily for the stimulation of human genital organs."

2.) I wish this case had gone ahead and been prosecuted so we could get a ruling once and for all on the harmful nature of vibrators to the good women of Texas. Damnit, I'm going to have to go out and get caught selling vibrators so I can be a test case.
