Speaking of test cases, I'm thinking of being one as well.

I had some foundation work done on my house. Hired contractor to do it. After work is done, I get bills from two inspection companies, saying that they were asked by my contractor to come do inspections (to verify that the work was done according to code). I was not told of this at the time, and I was not given any opportunity to shop around for the best price among inspectors. I have reason to believe that the bills are higher than they would have been had I shopped around.

My contract with my contractor says nothing about authorizing him to hire subs or inspectors on my behalf, or that I would be responsible for such fees.

When phoned and asked to pay the bills by these inspectors, I have been telling them that we don't have a contract with each other. These inspectors have said that according to California law, it's illegal for the contractor to pay them, as it would be a conflict of interest. They just keep repeating this non-responsive mantra over and over. My retort is that that's all well and good, but that as a result, they should have entered into contract negotiations with me before doing some work, and the fact that they didn't means that I'm not obligated to pay them their bill.

I've settled with one (for 70% of the price of the bill), but I'm tempted to litigate the other one. I think they're entitled to quantum meruit, and sometimes I just feel like being a dick, and I'd like to take it out on someone other than Mrs. Str8 for once. Any thoughts?

If by any chance you (and by "you" I mean any of you, not Alex deL, who I think is not in TCOTU) can see the Jumbotron (I think that's what it's called) on 44th and B'way from your office (or home -- you malingerers!) window, they're showing it live from 9:30 to 11:00 (or from 9:00 to 11:30).

I think you should be the test case. I want to hear the press talk about the vibrator backlash that will occur once the Supreme Court determines the anti-vibrator laws unconstitutional.

A rant that none of you care about

So, my horses are insured against mortality and major medical. I just renewed my policy and one of my horses had a sinus infection last year and they xrayed her head, found to cystic masses and ended up going in to remove them (thinking they might be causing the infection) and then didn't remove them because they looked fine. Now this year, all sinus infections are excluded from coverage...however, the initial form they sent out didn't list the exclusion and I filled out the renewal form and sent my money and now I get a letter saying her nose is no longer covered. A sinus infection is a pre-existing condition????? I HATE GREEDY insurance companies. Ok, that's all. Thanks for letting me vent. Have a nice day.
