Yeah, there's a write-up in some medical journal of treatment someone I know got, and based on the timing, hospital, age, and severity of what was wrong, I know exactly who they are talking about, and I bet almost anyone in our extended group of acquaintences would say "whoa, that's X!" if they saw it, even now, years later.
Sadly, I don't recall the exact HIPAA privacy requirements, but if you remove the listed identifying information is it automatically considered not individually identifiable? Or is there just a presumption? I can't remember. I'm talking HIPAA the federal law, not state privacy stuff.

Remove the 18 identifiers in the reg, and you're in the safe harbor. It's no longer protected health information and you can do whatever you want with it. The kicker is that last identifier though, "any other identifying characteristic or code."

I haven't seen the physicians' response but I think that they're arguing that they can be cross examined, and peer reviewed literature can be brought into evidence. The District Court Judge in Illinois seemed to imply that this evidence is being asked for impeachment purposes, and I would think that impeachment evidence should be given greater scrutiny than direct fact evidence. Given the assertion of medical necessity, it probably would be useful to have a few medical records showing medical necessity. I imagine that the plaintiffs do have and have produced a couple of these records.

OK, this makes sense. Although, in the case where the docs are primarily claiming that the procedures they've performed have been due to medical necessity, I think that allowing them to pick a few representative record sets is sort of troublesome.
I just wonder if the outcry would be similar if they were looking at past treatments of toenail fungus. (Oh, and the impeachment argument is kind of thin - testing the challengers' main assertion technically isn't impeachment.)

Almost as interesting as the alleged story brewing about Kerry and alleged recent infidelity is who the source might be...
Does this hit have Rove written all over it, or could this be a special delivery from the Clinton camp, et. al., to keep a guy who's clearly not "their guy" from the White House?

Or could it be that the woman's friend who went to the press about it some time ago was simply pissed at Kerry for mistreating her friend, and the press has been less than diligent about bringing this story to light? (It's not all black helicopters. Some things are simpler than that.)
Remember back when Drudge broke the Monica story that all the rest of the press world had decided we didn't need to know about? Maybe the suppression of this until Drudge got involved is the real black helicopter angle.

So you want us to believe that you were just perusing that medical journal in your free time and you happened upon this article and recognized it was your friend X?
Or were you looking at the medical journal because you knew your friend X's case was written up in that article and then with that knowledge you looked at the article and arrived at the conclusion that you could identify X from the information in the article?
