That would be a better argument if Ogden had been decided in 1937, not 1827

Oh, Shit, you're right.
Now somewhere I know I had a later interpretation of the contracts clause as individual right. Let me look around here...

But it is kinda funny you keep beating on that old coot. That you think anyone even pays attention to the historic (and widely, repeatedly self-denounced) racist politics of a nonagenarian from West Virginia shows you lack the basic understanding of politics required to post coherently on the topic.

But you have to understand that this is Penske's way. When he is confronted with an unpleasant fact about a conservative, he tosses out a well-worn shibboleth about a Democrat. In his mind, this cancels out the bad Republican and alleviates his cultural dissonance.
In other words, your analogy to the challenged child swinging blindly at a plane with a whiffle bat is spot on.

Nice defence of Byrd's and by association the DNC's racism. I hope they pay you well for distributing the kool aid.

The Right figured out sometime ago that, since the Constitution was old, by necessity, it would not contain many of the rights progressives sought in present day society. The Right figured “Fuck, We can use the Constitution as a sword. But wait... we first have to address our critics who will make the logical argument that the Constitution was meant to adapt to times. The left and middle will offer really strong arguments - I mean, shit... the Founding Fathers were all progressive.” The Right sat down and created of whole cloth, not unlike Intelligent Design, the school of legal thought known as originalism, traditionalism, etc... as a cover to push its political agenda via the judiciary branch.

Radical Islamic fundamentalism, right-wing conservative Americans, it's the same message. Life was better in the Good Old Days. It's all this damn progress and literacy and wimmin's rights that has brought us to the brink of Hell and it's time to turn back the tide before it's too late.

Guilt by association is a ridiculous concept. It displays nothing but ignorance, laziness, and intellectual dishonesty.

It goes beyond association. He is the conscience of the party. The conscience is a racist. What does that say about what the party thinks of itself and its message?
Why is so hard to call racism racism? Or a murderer a murderer? Or a perjurer a perjurer? Or a rapist a rapist? Or to acknowledge that committing those acts or indulging in those behaviours is wrong?
When did the moral compass of the Dims go so far astray?

I can call a racist a racist and a rapist a rapist. And a murderer a murderer. I acknowledge that all of those are wrong.
If you maintain, as you have consistently that because Byrd is a Democrat and I am a Democrat that makes me a racist, then I can call you an asshole. Because you are acting like an asshole and that is wrong.

Jessie Helms is the conscience of conservatives. So is William "the Gambler" Bennett and Pat "Diamond Mine" Robertson. Hypocrites? No, much more - symbols of the once-dignified Republican Party. Shame, shame, shame!
