Hope that helps.

HOW IN HELL could that help when your situation is THE POLAR OPPOSITE pretty much from WHAT ABBA WAS ACTUALLY ASKING ABOUT?

Since she can't answer Abba's questions, she'll tell everyone about her own getting pregnant excapades.

Just curious - has her lunch menu been posted yet?

Was your mom in her 30s when you were born, because if so, then Abba can tell her friend lots of baby born to 30 year old moms are really fucking grumpy- colicey, then terminally grumpy, and she should feel okay if it doesn't work out.

this is helpful.

I think the multiplier has to do with the ruined day. Consequential damages as it were. It's why "wedding photographer" is about equal to "divorce attorney" in the amount of potential negative feedback you can expect. (which keeps photoshop work up, and Hank in better scotch).
That would be ridiculous. For the damages claim to have merit I would think it would have to be primarily punitive. She claims the florist pulled a bait-and-switch. By insisting on up-front payment he did leave her without much recourse if things were not as expected on that day, which is why the suit itself is not so outrageous, notwithstanding the damages figure. Negotiating tactic?

Any "ruined her special day" arguments should go nowhere.

That's true.

But the Ivys have some very smart people and we're sure they'll catch up and, even if they don't, they'll do just fine.

More rEdiculous still is the use of "Rebels" by the Walpole (Mass.) high school team. I think they even have the confederate battle flag on their helmets, or did until recently. Up South, indeed.

BTW, I take RT's comment to describe two high schools in texas that feed ivy league colleges, who played their high school football game at Rice stadium. Is that too complex?

ETA: Looks like they've gone to crossed swords. Maybe the University of Mississippi sued them for copyright infringement recently.

Is that Yosemite Sam?

You read SNYC's post and are disappointed, because deep down you still believe SNYC may have some merit as a poster, if not as a human being.

I read this (thank's to your quoting it) and simply smile smugly having had all my views of her confirmed.

I suggest either using the ignore button or adjusting your expectations.

of course it is ridiculous. You can start with the assumption the justification is ridiculous. And consequential damages here are no less ridiculous than punitives. Unless there is some fact like the florist employed the brides last boyfriend who intentionally sent the wrong flower color as some sort of impotent revenge thing.

I think your "thank's" is incorrect.

"Elbogen alleges that the florist substituted pastel pink and green hydrangeas for the dark rust and green hydrangeas"

So she got the green hydrangeas but not the "dark rust" ones? There's no such thing as dark rust hydrangeas. Except for some green and white ones on the market, they range from blue to pink (and in between, meaning lavendar) depending on the alkalinity/acidity of the soil (Grandma used to put lime with her's to keep them pink. Or was it blue?) But not rust. Unless they are old and dried. Which she would bitch about. This lawyer better take some time off for a walk in Grandma's garden (or anyone's).

(Maybe you could get rust if you soaked them in food color like green carnations?)

Heh. My mom used to use hydrangeas to demonstrate the pH scale. Are they dying hydrangeas these days like they do carnations?

How very, very tacky.

aluminum sulfate/acid-->blue

Oh, please. I was (mostly) joking. But you've never had something like this happen? "Well, Not Bob is making an, ah, interesting argument on the limitations on consequential damages in contract cases, but I think that his colleague Fenwick's argument in the Shicklegruber case that there are no limits is the correct one. Hey, Not Bob, your folks do nice work. Here's a copy of Fenwick's brilliant brief, Judge."

If [I won't name the firm here, though it is public info] is on the bride's pleadings, it might be fair game. Not that it's binding, but I have been there, and it's a pretty effective approach with a state court judge.

AoN, I thought that in most jurisdictions, complaints weren't supposed to identify unliquidated damages. I've always thought that those who list a number were simply trying to attract attention -- something like an invitation by the lawyer for publicity.
