Benchmarking

Any folks out there willing to talk to me about how litigation technology/support is organized at their firm?

If so, PM me.

Thanks,

Anne

Suit in California

New lawsuit.

Employment lawsuit. The plaintiff, a [redacted] of the [redacted] California office, reprimanded several [people] for vulgar and profane conduct. He removed pornographic photographs and obscene cartoons from the [area], as well as two Barbie-like dolls which had been posed in a sexually suggestive position. As a result, his superior officer gave him a bad performance review, saying he was "too rigid, too textbook, and not people oriented." Eventually, he was fired for causing a lack of morale in the office.

Random CA law questions.

A friend of mine's mother just died and she had no will. She had a spouse and two kids. Anyone know how the intestate succession works for this?

I was also told that in California that gits certificates are not allowed to have expiration dates, and if they do they are void. Is that true?

On the latter, I have read that as well. I don't think the asnwer is they are void, however, because that wouldn't really help someone (ha--there's no expiration date, so it's void!). Unless by void, you mean someone coudl demand cash. From what I read, which was brief and a couple of years ago, I think the ruling (I believe some court held that an expiration date was an unfair practice) basically made any expiration date ineffective/invalid.

Consistant with my understanding; cert is not void, but expiration date is.

It's in the code, but I think it will be 1/2, 1/4, 1/4.

Actually I talked to my Dad. All community property goes to the spouse. For the separate property it is divided 1/3, 1/3, and 1/3. I thought it would 1/2, 1/4 and 1/4 but my father showed me the code section.

Still no clue on the gift certificates.

I am assuming the spouse is not the mother of the children?

(I'm just curious. Trusts & Estates was my favorite course in law school.)

Correct. You'd be surprised how many retailers fuck that up.

Don't you think often they know this but try and get away with it anyway.

No. People don't take time to train their staff and most managers are stupid. Bad combination.
