NY Biglaw attracts pushy people with big egos. There are tools everywhere though. I've had partners from small firms who think it's beneath them to negotiate with an associate, who try to BS me about what's market simply because they've got more years under their belt than I do, or who ramble endlessly because they like to hear themselves talk.

Also, I've had clients tell me specifically to be an asshole with the other side, be pushy, be annoying. Perhaps not incidentally, I've seen this have excellent results in negotiations - asshole lawyers can get others so pissed off, annoyed and distracted by the assholish personality issues that they lose their cool and aren't thinking straight, often giving a pass to comments made without asshole overtones and allowing us to walk through all kinds of shit while they grit their teeth over the bullshit the asshole is pissing them off about.

Then again, with the kind of stuff I do, anybody who says they have any particular experience that is very relevant to any given situation is pretty much full of shit - we're mostly making it all up as we go along, and he who wins is he who thinks best on his feet on 8 hours of sleep a week. Rattling techniques are more effective if no one has a clue what they are really looking at anyway.

This is pretty normal -- and is what I dislike the most about being a lawyer.* No one told me when I signed up for law school that my job would be "asshole for hire." Lest one think me too Sebastianish, I did take matters into my own hands and got a new job that does not require this nearly so much, and even when it does, I just call in the guy two doors down to be the designated bad cop - he seems to like it. Sometime, though, you've just got to do it.


*I'm actually coming to grips with being a lawyer and now think it's not half bad. Two years ago, I hated it with the fire of a thousand angry suns. A change of scenery can do wonders sometimes.

I'd be surprised if that happened w/r/t the deals that I participate in b/c 99% of the time the other side is trying to get money from my client. Seems counterproductive. What I am referring to is not assholish negotiating tactics but literal tooishness. Like I'd never want to have a conversation with this person away from this deal. It is some combination of the manner of speech and the words used that makes me think that these (typically) guys are way to full of themselves and are generally worthless human beings.

As far as negotiating tactics go, I think that there is a difference in level of results between assholish behavior and persistence. Persistence (whether warranted or not) in bringing stuff up or holding onto points typically pays in my experience, not assholishness.

There are assholes and tools everywhere, but in my experience there is a specific breed of NY toolishness that I run into about half the time I work with bigger NY firms (even with NY offices of non-NY firms). That's why I thought maybe it is learned behavior there.
