In a 218 to 201 vote, the ABA's policy-making body amended its ethics code to allow, but not require, lawyers to breach attorney-client privilege if they believe doing so would stop a client from committing a financial crime or fraud.

this is an interesting development, as the SEC attempted to require something similiar, but the position papers submitted by 80 or so law firms watered it down (to require the lawfirm to first go to the board and then, if necessary, withdraw "noisily"), relying on attorney-client privilege.

The point of dress traditions is to make everyone comfortable by making clothing irrelevant. In this way, black tie is somewhat like nudism, without all the towels on the seats. Yes, this means that the boys are all wearing the same thing and can't express their flamboyant originality by wearing their piano keyboard ties, etc. Most would agree this is a good thing.
When I receive a black tie or black tie optional invitation, my first thought is not, "Oh, those fuckers, making me dress up. I wish they would stop oppressing me." My thought is, "I hope everyone wears black tie." I feel slightly uncomfortable at a BT party talking with someone wearing a business suit or white tie, just as if they showed up at a poolside BBQ wearing jacket and tie.
Black tie optional accidentally makes all the people who wear black tie feel slightly more dressed up (not the point of the whole exercise, mind you) and the people who wear suits feel slightly less so. It reintroduces clothing, and noticing clothing, back into the party dynamics. ("Huh, I would have figured he owns a tux, with the money he's making at Cravath" etc.)
That said, I would rather go to a BTO party than a "creative black tie" holiday party, because there will always be some schmuck with a LED novelty tie, or a tie shaped like holly leaves, or some shit like that. I know it's not very Chrismassy, but these people should be festively beaten.

This business of blaming the client thing is quite odd. Generally, the problem seems less the client than a promoter of some legal, accounting, finance, or regulatory chicanery, a promoter who increasingly is an attorney. The attorneys have following bankers, consultants, and accountants down the rabbit-hole of selling legal, finance, and regulatory products.
The government responded to such activities in the tax area by enacting IRC 6111 & 6112, which require the registration of certain transactions as potentially abusive tax shelters and the maintenance of client lists with respect to such transactions. The IRS is empowered to demand such lists. Currently, there's litigation under those provisions where clients, suing as Does and Roes who have asserted privilege under Section 7525 (akin to attorney-client-privilege) or attorney client privilege to avoid having their identities disclosed. I expect the courts will generally find against such taxpayers, and if not, Congress will weaken Section 7525 and attorney-client privilege, to allow the IRS to get at such client lists.
I also expect that if attorneys in practice areas other than tax move away from acting in their traditional capacity as a professional with respect to a transaction, and toward acting as a promoter, those attorneys will face similar attacks on privilege. The privilege was not designed to protect lawyers acting as bankers. These aren't situations where where the client has done some evil shit and wants advice from a litigator. It's more a situation where some lawyer designs or promotes a tax, finance, or regulatory arbitrage/product/insert-euphemism-of-choice and goes CFO-to-CFO peddling the thing.

A friend lent me a copy of his high-performance coaching USTA newsletter. There's a series of pictures of Kuerten, Roddick, and Henin-Hardenne swinging through a forehand. I don't really watch tennis so I hadn't noticed before, but Henin's got great legs, and a great body period. I flipped to her stats on the web and she's something like 5'5" 125 lbs. Anyone who thinks she's a skeletor is smoking dope.

Hantuchova, who weighs about the same but is sis feet tall is the skeletor. Henin-Hardenne is the one I mistakely thought married daddy. she does bear a serious resemblance to the gal the mustachioed chick is dallying with, fwiw.
And speaking of tennis, I cannot decide if it is worth goig to the Open this year. Serena is out, Venus is likely out, Monica is likely out (if she issnt already), Lindsay's foot hurt in the finals at Carson on Sunday, Jennifer Capriati is injured and could be out. The women's matches will be a bore.
And on the men's side, there are only a handful of players I enjoy watching - Federer and Henman play net which is the funnest to watch though I am not enamored of either player. Roddick is fun but I am not enamored of him yet. i heart Agassi but he has been looking slow lately and at the moment, I dont pick him to go as far as I like (I predict quarters but I need to see the draw). I heart Phillipoussis but he isnt usually around past the round of 16. Herwitt has gone down the tubes. Blake is overhyped (I am loathe to admit). I am not sure there are other interesting players. Fuuuuuuuuuuuuuuuuck. Is this a good use of Labor Day weekend?
Editd to add that I forgot two of my laminated list men - Moya and Kuerten. Kuerten wont go far but we may not see much more of him bc his hip hurts. Moya goes quite far and will probably be making more visits to me in my dreams. maybe it s worth going to.
rest of lam list is phillipoussis, benicio del toro and anthony kiedis with mcconaughey on reserve.

I have 2 cats. I very briefly had 3 cats when I was in law school, I rescued the kitten. I took a look around and said you know what, 3 cats is too many cats and is verging on freaky, so I found a home for the kitten. I will stay at 2 cats, and since they are getting old, when the eldest dies, maybe I'll get a dog. I don't see getting another cat though.

Don't you mean itty bitty baby kitties with big kittie claws? Are additional points awarded if you talk to your kitties? What if you respond for them in a witty bitty voice starting sentences with "he/she says" (like "he says he's a hungry itty bitty baby kittie")? What if you have taken to calling at least one of your kitties Pretty Little Flower (the overweight one that has cow markings and was found in a trailer park)? :wink:

I don't know about how crazy this makes you, but since I am frequently one of the recipients to these messages and my response is pretty much always to type "Hi [cat's name]" that probably says something about how crazy I am.
