Trust In the Jury System

http://www.foxnews.com/story/0,2933,114890,00.html

So you are a defense attorney, and your client is on trial for murder. The jury comes back from hearing testimony and they find they've been robbed:

Quote:
Murder Jurors Become Victims of Another Crime

BALTIMORE (AP) — After listening to testimony in a murder case, jurors returned to their jury room to find that they had become victims of a crime — a thief had stolen their money, cell phones and car keys.
So what to do?

Quote:
Defense lawyer Maureen O'Leary made a motion to have the case declared a mistrial, but the motion was denied.

"If the crime that occurred to the jurors was the same as the crime they were deliberating on that would be one thing," the judge said. "But this incident is too remote."
What the fuck? To get the mistrial the jurors would have to have been murdered? Whether the murder of a smaller percent of the jury, say the alternates, would have been enough is still a case of first impression.

I've been trying to come up with a better answer for you than "dunno," but I can't, really. I know it didn't make it onto the new Evil Dead DVD (apparently because of music copyright issues). Best I can suggest is to (i) find a bootleg download site on the web (I didn't find one in my casual perusings, but I'm sure they are out there), (ii) haunt eBay, a copy will turn up there eventually, or (iii) head for a Deadite fan chat room and ask - someone will probably know or be able to get you a copy.

If it weren't abercrombie, I might buy this one

Gov. Bob Wise, a Democrat, contends that the shirt is a not-so-subtle play on the stereotype of West Virginia as a haven for incest. In a letter sent Monday to Abercrombie & Fitch's chairman, Michael Jeffries, Mr. Wise demanded that the company stop selling the shirt and destroy its entire stock of it.

"By selling and marketing this offensive item, your company is perpetuating an inaccurate portrayal of the people of this great state," Mr. Wise wrote. "Indeed, such a depiction of West Virginians undermines our collective efforts to communicate a positive representation of the spirit and values of our citizens."

I heard this on the radio this morning. What I thought at the time was that if a t-shirt can piss off an entire state, we have gone way too far along the PC trail and it is time to start hiking back in the opposite direction.

I also thought that this guy is stupid, most people wouldn't have even noticed the shirt. Now it will be flying off the shelf.

Dead Board Poll

Since we've been looking at the good and bad of major US cities, we might as well beat it to death with a poll.

If you absolutely had to move, where would you move and why?

This isn't a fantasy poll. This is a practical one based on your means and current situation. If you are so wealthy that you could up and move to the French Riviera and never work again, then that is a legit answer.

This is a tough question for me. I've lived in a lot of places and have never been unhappy. But when I think about moving someplace, I tend to get very picky.

The South: Nope. Out. Forget it. I know everyone down there will tell me it's not how I perceive it, but I've heard enough that it makes me keep my distance. Atlanta and Miami, included.

LA: Too LA. I would only move there if I had a cool entertainment job. Otherwise, what's the point?

Overseas? Maybe Paris or London. But it's just too far from friends and family.

I think I would move to Chicago or Seattle. Fun cities. Chicago gets so damn cold. But I dig it. I likes the vibe. Seattle seems cool too.

Or maybe I would just move to Hawaii and be a waiter or something (I imagine high-paying legal jobs are few and far between). I love it there.

How come everyone calls their state a "great state?"

What makes a state great? Having a reputation for incest must be one of the criteria.

Seattle. Cool things to do indoors. Cool things to do outdoors. Nice stuff to look at while you decide what to do indoors or outdoors. Ocean. Rivers. Mountains. Nice cities, easy commutes.

Kayaking.

I think I'd go with Seattle, too. It's a great city and I have family out there, so it would make sense.

For east coast towns, I think I'd go with Boston. New York is fun, but I think it would wear me out too quickly.

If we're being strictly practical here, the only places we could conceivably move would be London or.... London. I suppose some other large capital city might work (maybe Mexico City, Sao Paolo or Madrid), but not really (owing to the nature of mr.dtb's job, only a handful of cities have the business to support his area of expertise).

Now, if I change it slightly to places I'd like to live, and would be able to find work, Hawaii definitely tops my list. In fact, after Sept. 11, I seriously considered moving to Hawaii or New Zealand to escape the rat race and the terror threat (didn't get far with mr.dtb though). Not sure what we'd do there, but it seemed like a good idea at the time.

As for mainland U.S. cities, I like San Francisco, and I like Miami, but outside of that -- nuttin'. Chicago is cool -- but too cold, Boston is just so.... Boston, L.A. does have some appeal, but -- naah, and Seattle -- the weather is too depressing. And my brother lives there.

I've given this quite a bit of thought lately. My family is going to shift from double-income to single-income in the not-too-distant future, so we've suddenly become much more mobile (it's much easier to find one new job instead of two).

My wife and I would like to go somewhere warm. LA and SF are too crowded. San Diego is too expensive. It rains too much in Seattle (and probably isn't so warm there either).

Chicago would be cool except it's too fucking cold.

I've really enjoyed my visits to New Mexico, but there isn't much in my line of work there. Maybe Phoenix? I've never been but it seems like Arizona would be pretty similar to New Mexico. There'd be some space. My perusals of firms in Phoenix also indicates there is work for me there.

I could also go south to NC or Atlanta. Miami is much too hip for the likes so of me.

And although it doesn't fit my "warm city" criteria, I think I'd also trade my city for Boston in a heartbeat.

So what was my fucking answer? Phoenix, Boston, Atlanta, and somewhere in Research Triangle, NC.

Seattle. Duh. Cool ballpark. Cool football stadium. Reasonable cost of living. Clean. Thai food. Only 3 freeways.

Hawaii. But I've had friends that say island fever sucks. I'd have to be able to fly out for some football games and live music (other than ukelele).

Paris. If I had lots of money.

London would be my first choice, but I wouldn't mind living in Italy. Paris is phenomenal.

I've always dreamed of settling in a lazy banana republic, but that's not really practical.

In the U.S.: Out West. Denver or New Mexico. Never been to Seattle or Portland but I'm very curious. Like Bilmore, I like to be outdoors, and the weather/topography of Chicago just isn't conducive to that 7 months out of the year. I would ski/hike/snowshoe every day of every winter weekend if I lived in Denver. And it's mild in Denver in the winter. Much warmer than Chicago.

I'd love to have a boat somewhere too -- try getting a slip in a harbour here on Lake Michigan. Just a decent boat on a nice clean lake. The non-Great Lakes around here are clogged with yuppie boats and waverunners and polluted with industrial waste.

Paris really isn't that expensive. Much cheaper than many other European capitals. You can spend A LOT of money there, but you don't have to.
