Well, for one thing, a newborn is a life in being, which is where I advocate drawing the line. As for you second disjointed fragment, it expresses no clear thought. Please rephrase it in English and I'll try to respond.

It's an old legal term of art. I can see why it confused you. A life in being is a person, having been born and not yet deceased. See, e.g, the Rule Against Perpetuities, the common law definition of homicide, and the law of intestacy.

Its sort of funny to see what you thought I might say, particularly when you've gone so far out of your way otherwise to mischaracterize what I do say.

He watches SNL, and steals from it, then has the nerve to call me poorly read? I take it back. He is a bigger schmuck than I thought. SNL hasn't been worth watching in years.

To say the Court has expressed doubt about Roe doesn't mena that the decison was wrong. The Court was wrong in Plessy v. Ferguson and it was wrong when it decided the Internment cases.
In any event, I didn't base my argument on Roe. I based it on the Constitution. The Fifth Amendment guarantees each person the right to be secure in her person, with the right to life and liberty. The Amendment predates Roe and it predates any decision calling it into question.
|
On the first paragraph, fair enough. The Court has been wrong before. The Court is signalling what's coming sooner or later about Roe. Say they deal with Constitutional issues as they arise, and insofar as they have not been dispositively addressed before. The Fifth Amendment?
I'm going to have to reread what "secure in her person" even means, to tell you the truth. But life? OK, so you have your exception for life of the mother. Liberty? I'm not sure I've ever heard it used in this context. Nobody is going to jail. Nobody loses their otherwise protected freedoms. They can still carry a gun. They can still stand on a soapbox and yell. So no, that wouldn't seem to fly, but I'd be interested in hearing more on either life or liberty. And "secure in her person"???
I'm sure you and others disagree on this, but its seems pretty clear where this ends up. Your pro-Lifers are going to end up in Indiana, Michigan and Missouri. But Illinois will get lots of 20-something women in return. Not sure how the tax distribution plays out, but I think Indiana comes out ahead.
Hello

Ummm, I understand that you have read 2 books (at most)written by Orwell. To be fair, I take issue here with your word choice, not your education. Scalia has used Orwellian before.
Anyway, tell me one Orwell book besides the 2 you've read and a time when you'll submit to a quiz, then i'll withdraw the comment. I do feel that if you have not read Down and Out in Paris and London; Keep the Aspidistra Flying and Coming Up for Air, then perhaps you should try not to characterize his style.
|
I have read Down and Out, and his essay on language, as well as 1984 and Animal Farm. And I'll submit to a quiz when you can prove to me that you are not the unfortunate product of cousins marrying.

Anything that can be created in the midst of a mad dog blackout during senior week is not sacred. Conception might as well be a beer shit. Anyone can do it - you, yourr neighbor, the guy down the street, dogs, caats, your cousin who's reaally into goth music... hell, retarded people can knock eaach othher up. Is that sacred? Is God's hand at work? Please. You're an animal, breeding. Your upper middle class guilt aand need for some phony half-assed spirituality may goad you into believing some cosmic forces brought you your precious little bundle, but the fact is that, but for some randdom timing, perhaps a swivel of your wife's hips at the right time or a sudden shift to dog style, junior might haave been another kid entirely. Its random and most anyone can do it. These self-important moralizers need to get over their ballooning egos...
Like Ray Davies said, "[You] are an ape man..."
