Speaking of heroin and sharing, here's another story liberated from (yet attributed properly to) CNN.com:

STAMFORD, Connecticut (AP) -- You have the right to remain silent, but what if you vomit evidence before police read you your rights?

Vincent Betances wants his drug-dealing conviction thrown out, arguing that eight bags of heroin he threw up after emergency medical treatment should never have been admitted into evidence.

He contends police illegally seized the evidence from an ambulance after asking him if he'd swallowed heroin -- but before reading him his rights.

The state Supreme Court heard arguments in the case Wednesday and is expected to issue a ruling this summer.

While handcuffed and in a police cruiser, Betances began sweating profusely, turned pale and had difficulty breathing. Betances admitted he had swallowed four bags.

A paramedic gave Betances a medication to prevent the body's absorption of the drugs. A short time later Betances threw up eight bags of heroin, which an officer seized.

Assistant State's Attorney Toni Smith-Rosario argued that police should not be penalized for protecting the public, including defendants in their custody.

"Most defendants are grateful when police save their lives," Smith-Rosario said.

Suzanne Zitser, a public defender representing Betances, countered that exceptions to the Miranda warning must satisfy stringent requirements.

"It's not even a close call in this case," Zitser said. "There was no threat to the public or police officer safety."


Wouldn't this fall under the Plain View Doctrine?

Possibly, but I think the issue here is whether you view this as substantive evidence, in which case it would apply, or the argument the suspect seems to be making, which is whether the act constitutes a voluntary confession, otherwise Miranda wouldn't apply. It's an interesting argument, but probably a loser.

I seem to remember a case where the police offered the suspect a cigarette, and the suspect left the butt in the ashtray of the police car. The police then took it and had the suspect's DNA extracted from the cigarette and used that evidence to convict. The court basically held that if the police did not do this with the intent to coerce the defendant to give up evidence, it was allowed. I'll try to find the cite.

Yes.

And he's not untouchable. Look at what's left. Besides, the judges are starting to try to manage the outcomes. I believe Simon may have said last night as Josh and Carmen were standing there, that neither one had a chance of winning the competition. He's out next week. You read it here first.

With respect to Trenyce, I think there was a caveat. They said she wouldn't have a chance, unless she started to step it up like Kim L. has done in the last couple of weeks. The other two: no chance in hell was the message.

I think that you need more facts. Like did he throw up before or after April 14, 2003, and if it was after, how much insurance does the ambulance company have.

Yes, he knows about the FB. But he doesn't know my moniker, even though a couple of FBers know my identity IRL. Even though he is (gasp) a lawyer, he doesn't peruse the boards. If he did, it probably wouldn't occur to him that his Mrs. is the AMM.

And, no, he doesn't know about the secret cigarettes, either.

Mrs. Sandwich knows that I peruse the Mom & Dad board as well as my regional and practice boards, but she does not know I read this board. Content-wise I don't think she'd care, but if she knew the amount of time I waste reading and occasionally posting here, she'd probably be irritated.

I know no other posters and thus do not send PMs and emails. But if I did engage in the exchanging of risque and flirty PMs to female posters (which I believe is pretty harmless) I sure as shit would not tell my wife about it. But of course I am also a secret cigarette smoker so perhaps this is not surprising.

There is no such thing as "secret cigarette smoking."

When the OM falls off the wagon, I know. I sometimes choose not to mention it, but it's a little hard to hide the aroma from clothes or hands, no matter how careful you think you are being.
