sightseeing in America

just got back from a week off. Talked to a coupla doctors (no comment) and a lot of blue collar family members. Observations:

Doctors are not_democrats, or at least mine are not. One I saw teasingly accuse another of raising her kids as liberals, and she almost punched the accuser. In sitting with one in his office (for, you know, a doctors visit), we discussed malpractice rates etc.... Not democrats.

In a family that largely comprises democrats, all republicans are employed. Several democrats are not. Unionized tradesmen in the Chicago area are, apparently, getting killed in this economy. And these guys are pissed.

On another note, I'm passively supporting Barack Obama for Senator in Illinion (Democrat) over Jack Ryan. Jack's story just seems a little too contrived. Harvard business type goes to the inner city to teach for awhile, and then runs on his record of service. If his hair was grey, I'd feel a bit better. But he's got dark curly hair, and it just seems implausible that it wasn't all a contrived effort for political office some day. Nothing wrong if it was, but it just seems a bit too disingenuous for a Republican. Besides, Obama beat the pants off of Daniel Hynes and the rest of the Democratic machine in Illinois.

So, for you democrats looking for a place to throw a few dollars that might take a seat from a Republican (Fitzgerald is retiring because his Bell's Palsy is making him uncomfortable in public ), Obama might be a worthwhile place to throw some money. I'll add that even the Illinois conservatives don't seem to have too many complaints about him.

Hello

Dispatch from the War on Drugs

AUSA and defendant reach a plea deal for 10 to 16 months; later find out that an enhancement applied that neither side recognized. So the AUSA, being the decent sort, allows the D to back out of the deal and re-plead to a different offense so the unintended consequence (151 to 188 month sentence) doesn't result and both sides get the deal they bargained for.

But then the judge publicly accuses the AUSA of not properly upholding the Ashcroft policy (how that is any of his fucking business, I don't know). He orders the AUSA to prove he's got the DOJ's approval to plead the case out, because he thinks the local USA has pussed out on Ashcroft's directive too often.

Florida Judge Complains U.S. Prosecutor Is 'Weak-Kneed'

Quote:
"Maybe this is a bad outcome if we just play by the rules," Moore said. "But maybe it is playing by the rules that will eventually illustrate the wrongs within the system that will enable Congress to adjust the system to put discretion back in the hands of judges."
I'm sure the defendant appreciates being the victim of the acknowledged injustice that might eventually result in Congress amending the Guidelines. The guy just admitted he doesn't believe in prosecutorial discretion, but he wants to send a guy to prison for 188 months in order to vindicate judicial discretion. Nice.

WTF? This esteemed gentleman should STEP DOWN FROM THE BENCH and get appointed USA if he wants to control the prosecutorial function.

Don't put words in my mouth. She's the tomahto. Then again, Hank Chinkaski, BA 1989-91, Law 1991-95, perhaps is the tomaaahto.

Starting with his name. As long as he looks more like the Harrison Ford Jack Ryan than the Ben Affleck Jack Ryan, i could maybe believe him. but it sounds like he's youngish and thus more to the Affleck side. Affleck = contrived.

I leave out the Alec Baldwin Jack Ryan for obvious reasons.

Small procedural point - plea was already in, the judge was not letting him withdraw it. (I think the standard there is manifest injustice.) So, he's still just playing judge, not prosecutor.

Can't disagree on the larger point, though.
