As much as I appreciate the strict constructionist view, I think "relgion" should be read "religion(s)". I also think that would raise issues with the right to associate clause.

I feel bad for this judge, but if the activist judges provoke the public, they assume the risk of being impeached, being recalled, having courts' jurisdiction restricted by legislatures, outlandish amendments to state or the federal constitutions, being assassinated &c. Boston Globe article
Yeah, right. Similarly, judges on the crim rotation better not get too frisky, or Skek will absolve the rapists, theives, and pedos for their murders, too.

There is no rationale that justifies or mitigates what happened here and your post is a shitstain effourt that implies that there is. The only right minded result here is that her families killers are caught, over 18 and executed and before that brutally gangraped in prison.
Maybe, but the only left-minded result is to give the killers a free pass under a Constitutional perversion, like the exclusionary rule.

Just when I thought I was starting to figure it out.

Being new, I am still having trouble getting a handle on everyone's personalities and their political persuasion. This Supreme Court thing has completely scrambled my impressions and now I can't remember who is what.

In an unrelated observation, when I ponder the concepts of the European street or the arab street or international law or opinion or the UN or France (other than when I am drinking Dom or Petrus) i am reminded of George Washington's cautionary warning,

"Against the insidious wiles of foreign influence, the jealousy of a free people ought to be constantly awake; since history and experience prove that foreign influence is one of the most baneful foes of Republican Government."

I Concur.

I'm the hard-core rightie.

Hence the "O'Connor/Rehnquist/Kennedy/Scalia" top picks.

(I'm fairly certain we're all a bit more subtle and varied than our screen personas might suggest.)

(Well, except for Ty. He's really a loon.)

There have been other quizes hereabouts that shed more light than this one.

I think Ty's comment was about the light shed upon the results of each participant, not on the test's creator.

So "in god we trust" and "one country under god" raises no 1st amendment issues. These instances, however, are quite different from the ten commandments case, in that the latter is based on beliefs held by particular religions rather than a general belief in god.
My gut agrees that there is a meaningful distinction, but I lack your confidence that it can be consistently drawn, or that the fact that they are distinguishable saves the vague "in god we trust" utterances.

Well, the function and on going value of the test is certainly embodied in it's participants- but I ask you Gatti- can we really ignore the role the Creator had in enabling the test to be?
