How close does it have to be? Is intent part of the equation? How about likelihood of contact of saliva with person given the distance between the spitter and the spat upon?

Seriously, tho, in any circumstance where a stranger spits at another because the object of the spitting belongs to a group or makes a speech the spitter disapproves of is inappropriate and disgusting. And it's assault. Somehow, tho, I doubt that Slave would have objected had Cpl Sparling launched the first loogie.
