What state are they in? It is OK in some states.
I think the place of business restriction is to reduce the chance a minor could receive the alcohol.

It was the SNL rerun with John McCain hosting. THe guy whined just like him and did that whole angst thing. I did a little checking on the internet and have confirmed that, although the White Stripes have played on SNL, they did not do so when John McCain was hosting. When McCain was hosting, the guest band was, in fact, The Rapture.

Perhaps. The better argument, I think, is that that the repeal permits states to regulate alcohol sales within the state generally (by, say, enacting blue laws, taxing, or banning sales altogether), not discriminate against out-of-state suppliers by, basically, banning out-of-state transactions, except to the extent that it furthers the laws of general application in the state (e.g.: a dry state does not need to permit out of state imports just because it is interstate commerce). Or: you have two constitutional "mandates," one clear the other (perhaps) implied. At best this leads to a balancing test, and there isn't really a colorable public-interest justification for the discrimination.
Ultimately, as with so much, I imagine it will come down to (i) who has the better lobby, (ii) whether the repubs decide it is worth it to make a large concilliatory economic gesture towards CA, and (iii) which political groups decide the wine-drinking-version of the elite are their natural constituency and therefore the fight is a useful symbolic overature. I'm not sure where any of that comes down.

Does a band ever sound good on SNL? Thanks to Shape Shifter, I saw a little of the show this weekend, including a number by Pink that sounded whatever, tho' that could be Pink (sorry, Slave). I haven't watched it since the last millenium, but it seems to me a setting designed for mediocre performances. It's like saying the drunken sex wasn't good (sorry, Sebby, but it just seems that way because you're drunk).

Or: it could be that as a business it is assumed to have a license to buy wholesale, which gives one all sorts of nifty perks in buying things supposedly not available to the general public at favorable prices.

In general, yes, but not so much among many of the smaller non-prestigious wineries, which do, in fact, have trouble getting wide distribution. They don't have the econ clout, but they employ and they vote. They are the nice, photogenic "struggling independent farmers" as opposed to the ADM-agribusiness of Gallo.
I think it would be more wasted because of the "fuck CA, they all vote Dem anyway, notwithstanding Arnie" thing. It would be interesting if Arnie would take up this cause, even if only in passing, to see what other support it garnered.

The wine club I just signed my father up for requires a signature for the delivery of the wine because of the selling to minors thing, and will charge extra if someone is not around to receive shipment, so they prefer (but don't require) shipping to a business address.
Maryland can't receive wine under a law that has long been touted as protectionism for Maryland wineries (which need all the protection they can get), so I haven't experienced this myself. Must be nice. I am considering having wine shipped to a friendly co-counsel in DC, though.

I wasn't being clear (gasp!) - my impression was the industry is trashing, or even trashed. I know people looking to dump their grapes on whomever might give them something for them, and who are desperately seeking other land uses. Sorry.
