I almost wonder why the NFL players union or whatever the trade agency for sports family lawyers don't hold seminars on how to properly structure prenups for guys who are likely to pull this sort of shit.
All of these the allegations are just fluff if the prenup said half plus 20%.

How bad can the facts be? Strikes me as either bad lawyering or oddball law.
ETA: Bad lawyering, indeed. Strahan's lawyers put together the prenup that spelled out the obligations: 50% of marital assets plus 20% of income earned during marriage.
What kind of idiot lawyer would create a prenup that gives 20% of income earned during a marriage when most of that earning is going to come during the first few years of marriage?
|
Scroll, then post I guess.
Sounds like a legal malpractice case to me -- is the claim an additional marital asset she gets 50% of, income she gets 20% of, or both?
Even though she didn't ask for it, the judge gave her back interest on the 20%, so the 20% was supposed to be paid to her each year during the marriage. So I think he enjoyed dispensing a bit of justice here.
She's cute.

No kidding. So, question for the unfulfilled divorcees: A friend of mine (more a friend of a friend, but whatever) is going through a divorce. And has taken up with a new someone since starting divorce proceedings. She's concerned that doing so will harm her in the divorce settlement, and harm her chances regarding custody of her child. Why does any of that matter? The assets are the assets, and they get divided by whatever formula applies. And the child is the child, and custody is assigned in the best interests of the child. Is sleeping with someone else during a separation grounds for unfitness? She's not a crackhead or anything--just horny.

The only other explanations for this kind of ruling are that the judge thought he was either stashing or wasting assets - and he may well have decided both were issues.

The judge may well have also decided that he was stashing:
"Jersey judge [in January] slammed the grid great as evasive, untruthful and "not credible" - then upheld a $15.3 million prenup that Strahan's lawyer had drawn up"

Depending on the judge she gets, yes, having sex outside the bounds of holy matrimony can influence the outcome of the custody hearing.

The NFL does run a workshop for all new players on financial stuff and conduct. And the relationship between the two. I'm not sure whether the advice is more sophisticated than that given to high school students though: "Keep in your pants".

In my experience with a similar sort of thing, other parties didn't play much of a factor in the outcome of the divorce. I suppose the personalities involved probably play a factor, but it seemed like after-the-marriage-functionally-if-not-legally-died relationships didn't really matter.

Yep, that was me.
Hell, I do that to people who are NOT my date!!!! I even shook a gay man's penis in greeting!!!! The penis was hanging out though so I did not have to move any pants.

I have now learned that in DC, adultery is a misdemeanor.
I have also learned that three-card monte is also a crime.

I think it is still on the books in NY, too (adultery). I recall that from Law and Order.

Wikipedia confirms that. It also informs me that in Maryland, adultery results in a $10 fine.

Do you have to be married to commit adultery (as defined) or am I adulterous whenever I have sex?

In DC, you have to be married. But you're still a fornicator. Perhaps a californicator.
