Haven't read it, but from the radio it sounded like O'Conner's concurrence (in a 5-4 decision) was concerned with the things we talked about -- using state power to benefit private interests -- but said that on the facts of this case, those concerns were not applicable for various reasons, and therefore she was OK with the public benefits of the project.

- SEOUL, South Korea -- The two Koreas agreed Thursday to seek a peaceful resolution to the international standoff over the North's nuclear program, but the rivals failed to set a date for resuming stalled disarmament talks.
The North has stayed away from arms talks for a year, citing "hostile" U.S. policies. Last week, North Korea leader Kim Jong Il said the communist state could return to the talks if it received appropriate respect from Washington.
"The South and the North have agreed to take real measures for peaceful resolution of the nuclear issue through dialogue as the atmosphere is created with the ultimate goal of denuclearization of the Korean Peninsula," South Korean Unification Minister Chung Dong-young, Seoul's head delegate, said while reading a joint statement.

Something's missing, presumably with the radio. O'Connor wrote the dissent. Looks like Kennedy wrote a concurrence along those lines (but that's after a 30-second skim).

Nina Totenberg said that O'Connor wrote the concurrence, and then she said she wrote the dissent. I have to admit that this seemed unlikely to me, O'Connor's reputation notwithstanding.
