Other than tax cuts for the rich and judges, Mitch's goal is NOT to get things done but to block them. That's a lot easier than getting things done. And the tax cuts he can accomplish through reconciliation.

If Schumer can get a choice bill through he will be a hero, but the path is through some combination of Collins, Murkowski, Romney, Sinema and Manchin. But I suspect both Romney and Murkowski could even be convinced to nuke the filibuster on this one.

So many Democrats think of success or failure as passing legislation, and so they look to their Senate leader as a leader of the party. Nobody thinks of McConnell as the leader of the GOP. The way Democrats look to Pelosi and Schumer as leaders and argue about what Congress has enacted as the measure of the party's fortunes displays an incredible failure to comprehend politics.

If we're placing random bets, I'd bet an actual justice did it. Alito himself or Clarence Thomas would be my first bets. Justices have a life time appointment and no consequences, and really most of them have no fucks to give. You can hear the arrogance and self aggrandizement in opinions (or draft opinions, more precisely) like this one. Rules don't apply to them.

Most of the clerks are careerists looking to find the right asses to kiss, I think it unlikely any of them do this. If it's not a Justice, my second bet (can I do a box here?) would be clerical staff nearing retirement. I'll bet Alito's secretary absolutely hates him.
