In my view, yes. The level of impairment is typically greater,* and a guy on the phone can fucking hang up and pay attention, while a drunk driver can't do that.

I realize that I have an emotional reaction to the issue because of my family history, but your claims that a guy on a cell phone is more culpable/dangerous than a drunk driver is a mind-boggling.


* I'm too tired to dig up statistice, but I have seen studies re levels of impairment from talking on the phone, and IIRC, it's about equivalent to 2 drinks which, for most people, if BELOW the legal blood-alcohol limit.

Alex is right about the caller's ability to drop the phone and concentrate vs. the drunk who can't. But I say, get them both off the roads and the crazy speeders* too. Better yet, off with their heads!

*Crazy speeders being the ones going much faster than the rest of the traffic, not the ones just keeping up with the rest of the traffic, like me.

My scariest car ride was on a business trip. Partner (notorious cell phone driver and speeder) rented a car. So we were zooming along the highway in a strange town and he got a conference call on his cell phone. He held the cell phone in his left hand (he didn't yet have hands free) and "talked" with his right hand to emphasize his points, leaving no hands on the wheel. I was whimpering and praying I wouldn't have to fly home in a body bag.
