Campaign Finance Law
As someone who has to deal with these insane and complicated laws on a daily basis, I must say that they are counterproductive. Like with the tax code, they only end up screwing the small candidate who can't afford the attorneys. I think they should all be scrapped but there should be full disclosure. If a campaign receives any donations they should be required to post the amount and the source (and by source I mean original source) on a public webpage before they spend one penny of it.
I would also scrap all PACS etc. People use these organization to hide behind. No limits but full and open disclosure. In other words only individuals and public corporation could donate to campaigns. Corporations that donate would have to make a specific disclosure to their shareholders every election cycle of the donations they made and explain why.
In addition, I would require campaigns to declare all their cash on hand five days before the election and they would not allowed to spend any more money than that (to stop last minute donations from nefarious sources that the press can't expose).

Why are you carving out PACs? If me and 100 of my closest friends want to form a PAC to protect the tsi tsi fly, why shouldn't we be able to?

Why don't you all just sign a letter (or whatever) and enclose 101 checks to each candidate/officeholder whose vote you want to buy?

Maybe we want to buy advertising - I think NBC would rather receive 1 check for $100,000, rather than 100 checks for $1,000.

Then why don't you donate to the tsi tsi fly organization? Why do you need an organization to pool your money? What is the difference between a hundred of you each donating a dollar as opposed to each of you donating a dollar to a group that then donates a hundred dollars (unless you are try to hide something)?

Everyone can donate how much ever they want to any politician as long as they disclose it. Corporations are a tricky situation because they are legal individuals so it seems they should be able to donate to. What is in a corporations interest is not necessarily in the interest of all its shareholders separate interest. So Corporations should be able to donate as long as they can justify that such donations are in the interest of the shareholders as a whole.
But it all comes down to individuals.
PACs are just set up because individuals are limited on how much they can donate. If you get rid of limitations on individuals you can get rid of PACs.

We are talking about giving to campaigns. If you want to run your own ads there are no rules (even under todays laws). You only have to disclose if you give to a campaign. But if you and fifty friends want get together and run attack ads on anyone is OK.

What do you think the tsi tsi fly organization is? How do you think it's funded? Maybe my organization has a different reason for wanting to save the Tsi Tsi fly. The question is not whether there are work arounds, but rather, why should my speech (or association) be prohibited.
