Is that really a fact? Think about it from a defamation analsysis. Clearly this statement -- "You have committed actions that violate board policies, for which the penalty is banning." -- is a factual statement, capable of being proven false and subject to a defamation action. But I think the statement "You should be banned from the board" is unactionable opinion.
