The HIPAA violation was through the preemption provision of the law. If the privacy rule in HIPAA had been applied to the request, the records should have been surrendered.
Is the Illinois law more strict than most such state provisions? In other words, is preemption not going to control in the other states where the recs have been subpoena'd?

Money is fungible, chucklehead. In any event, I meant it seriously.

No, I am assuming only the women will have it used against them later. It is the old double standard.

Okay. Stop buying Penthouse with my tax dollars.

Not Me--you may use my tax dollar to buy a vibrator, though. Society would benefit from your extensive use of one.

No need for tax dollars to buy me vibrators - I work for a living. It doesn't surprise me that Dems support government-sponsored sex toys since they think the government should pay for everything else, too.

It will have to be a state by state analysis. I doubt that there are as many state laws that are as strict, though there have been changes in Texas law that I'm going to have to analyze in light of this case.

I think the supremacy clause stuff in there is fascinating. State law would NOT govern in this case absent HIPAA, because the supremacy clause would allow federal common law to trump state law. But because HIPAA's regs specifically look to state law for a preemption analysis, HIPAA incorporates any state laws that are more restrictive to privacy into state law for the purpose of supremacy law analysis.

Didn't Penthouse Mag go out of print, or is that just my wishful thinking.

FYI - that is Hanoi Jane in case you didn't recognize her. They were at an anti-Vietnam War rally.

Won't influence the election but I found it amusing.

Money may be fungible. Ownership of it is not. And even if you meant it seriously, I've known enough Harvard women to say that the talent pool is at best a mixed blessing.

I take it you haven't seen too many Harvard women in your life.

But if they use student fees to fund it and if at least some of those student fees were paid with federal student loan funds, wouldn't that count as your tax dollars?

Not sure what you meant by ownership, but I strongly suspect (a) Harvard takes federal money, and (b) sets its tuition prices (including student fees) in part based on the amount of (a).

As for your second point, there aren't too many 18-22 year old women I wouldn't want to see naked.

Rest assured, however, that those few will be the ones that pose.
