I have heard that a legal challenge is likely if the referendum passes, but I haven't heard someone I respect suggest how strong the claim would be. It would have been best if that challenge could have been heard before Election Day, but I guess that's not to be. If the thing passes, Bush and Kerry will split Colorado's votes 5-4, with the only question being who gets the extra one. (In the most recent poll out of Colorado, Bush is leading 47-42.)
