The other contestants were focused on his stitch work. It could not be proven that he didn't do the stitch work. The judges were told about it. It was a strike against him going into the competition. That is a penalty. He was not on an even playing field with the other contestants because he submitted something over budget. The rules don't necessarily have to lead to the harshest penalty for every violation.

And she did. In her critique she was given credit for it. She didn't win, but she was acknowledged to have accomplished quite a lot with limited means. The judging is based on a point system. She may have gotten extra points for that. Jeffery may have had points taken away for his being over budget. I wouldn't be surprised if the point spread was tiny between Jeffery and Michael (who clearly came in last).

However, I did finally watch the finale of Flavor of Love, so if anyboy wants to discuss that, I'm game.
