It's called "event billing" you don't bill out until the patent issues. Or, each time an event occurs. You record an assignment, you file the application. Usually those are flat fees based on the largesse of the original estimate. 5K for a patent app, etc.

The event billing approach is from her b school discipline....attys are notorious for being bad managers of firms. Some are amazing at it, some not so much.
