Well, from Volokh :
"The New Jersey court gave the state legislature 180 days to do one of two things: either (1) amend the state marriage laws to permit same-sex couples to marry or (2) create a parallel statutory system “which will provide for, on equal terms, the rights and benefits enjoyed and burdens and obligations borne by married couples.” This parallel system could be called “civil unions” (as in Vermont and Connecticut) or “domestic partnerships” (as in California) or something else. Under #1 the state will have fully met its constitutional obligation. Under #2 the state may meet its constitutional obligation but will invite further litigation on the issue. Litigants will get a second bite at the marriage apple."

As for equal protection, when do unmarried cohabitating heterosexual couples now get these same benefits?
|
You* have the option of getting married, no?
*Assuming you're heterosexual

Take it up with the New Jersey Supreme Court:
- The Court perceives plaintiffs' equal protection claim to have two components: whether committed same-sex couples have a constitutional right to the benefits and privileges afforded to married heterosexual couples, and, if so, whether they have a constitutional right to have their relationship recognized by the name of marriage. (pp. 19-21)

According to RT's post, he said:
"Yesterday, in New Jersey, we had another activist court issue a ruling that raises doubts about the institution of marriage."
Was he implying that the NJ court had allowed gay marriage? Hank probably would say so.

That was pretty much my brother's reaction. Spain and South Africa seem much more appealing in that context.

|
I thought the ruling was that gay couples have to have the same "rights", but the majority left it to the legislature to decide whether that would be called a marriage or a civil union or something else.
No?
I found it interesting that the decision is unanimous. My understanding is that New Jersey has a long tradition of attempting to balance its Supreme Court, so that if a judge of a R background retires, a D governor will appoint an R replacement.

Fuck. STP, Sidd, STP.
But Ty -- I highly doubt that Bush or the person who wrote the speech is confused.

When they walk down to City Hall and fill out a form. Is that too complicated for you?

I don't think gay/anti-gay equates to Rs and Ds (I mean people not who pushes the issues).
the city of Detroit voted for Kerry at about 90% in a state he won by about 53%. meanwhile our "gay marriage ban" passed by about 60%, and in the City of Detroit by about 60%.

Wow, yeah. So much for the press accounts of 4-3. The three were dissenting from providing actual gay marriage, and merely allowing the legislature to consider it.

More lies about stem-cell research. Sorry: They're clearly implying all sorts of stuff that isn't true, right?
As Rep. Sherwood didn't already have enough problems.
