That argument doesn't work.
Cops, the FBI, the military, etc. -- all are working to protect our citizens from harm all the time against all the threats.
At the same time we do put limits on what they can and can't do in pursuit of their task, and appropriately so.
Do you really want cops to have the legal right to give you The Belly Slap the next time you're stumbling drunkenly down the street at 2:00 a.m.?

Is that what we were talking about? Police actions within the US?
All this time, I thought we were we talking about Congressional clarification of allowable conduct during CIA interrogations on foreign soil of unmarked, un-uniformed terrorists from "armies" that are not signatories to the Geneva convention.

We were.
Maybe if I say it again for him slowly this time he will get it.
When it comes to domestic policing, we do restrict the police, even though it makes us less safe (from criminals any way), in order to protect our rights. We sacrifice some safety and protection to insure our liberty.
When we are talking about interrogation on foreign soil of unmarked un-uniformed terrorists our rights are never at issue. So there is no reason to restrict the interrogators to protect our rights. Restricting them so they can not do their job as effectively as possible does not help protect our rights or benefit us in anyway, where restricting them does put us at risk.
